Monday’s Supreme Court decision allowing Donald Trump to continue developing key parts of his attack on vote by mail is alarming. But it should surprise no one.
It is only the latest decision from a far-right majority that has repeatedly shown its willingness to undermine our rights and freedoms, remove limits on Trump’s power, and impose an extremist right-wing agenda the public never voted for.
This Supreme Court is not merely out of touch. It has been captured by a right-wing movement that spent decades building a judicial pipeline, manipulating the confirmation process, and installing justices who would deliver the outcomes its wealthy backers demanded.
Now that majority is using its lifetime power to do what the Far Right often cannot accomplish through the democratic process.
Tell Democrats in Congress: expand the Supreme Court under the next pro-democracy president.
Across cases involving voting rights, abortion access, LGBTQ+ equality, protections for workers and consumers, corporate power, and presidential accountability, the pattern has become impossible to ignore. When our fundamental freedoms conflict with the Far Right’s agenda, six justices consistently put that agenda first.
Monday’s ruling fits squarely within that record. Rather than stop Trump from pushing ahead with a scheme to disrupt vote by mail and rig the midterms, the Supreme Court’s majority cleared another obstacle from his path.
A Supreme Court this compromised will not reform itself, and waiting for this majority to suddenly respect our rights is not a strategy we can afford.
The Constitution does not require nine justices. Congress has changed the size of the Supreme Court before, and it must be prepared to do so again under the next pro-democracy president. Expanding the Supreme Court is necessary to restore balance, break the far right’s stranglehold, and ensure that our freedoms are not left at the mercy of six unaccountable extremists.
