Washington, DC — In response to the Supreme Court’s 5-4 decision narrowly overturning the Fifth Circuit and upholding states’ right to count timely ballots received after Election Day, People For the American Way President Svante Myrick released the following statement:

“The Supreme Court was right to overturn the decision of the Fifth Circuit, but it should have been decided 9-0. This case shows just how much Donald Trump’s nominees have corrupted the entire federal judiciary.

“It was three Trump judges who comprised the unanimous Fifth Circuit panel blocking states from counting certain absentee ballots even though they were mailed on or before Election Day: James Ho, Kyle Duncan, and Andrew Oldham. All three of them are considered top candidates for Donald Trump to fill a potential Supreme Court vacancy. And two of the four dissenting justices today were put on the Court by Trump.

“Today’s opinion shows the importance of the Supreme Court in protecting our freedom to vote – and to protecting us all from Donald Trump’s judges.”
